This Privacy Policy (“Policy”) sets forth our practices regarding the collection, use, and disclosure of information through our website acue.org (including mobile compatible versions of such website, the”Website”), and online services that we operate and that link to this Policy, including but not limited to open enrollment courses, other courses for faculty development, and full certificate programs (collectively, “Services”). This Policy applies to information we collect on this Website, through your use of the Services, email, and any other electronic messages between you and this Website and/or Services. This Policy does not apply to information collected by us offline or through any other means; or by any third party that may link to or be accessible from or on this Website.

If you do not agree with our policies and practices, you may opt not to use our Website or Services. When accessing or using this Website or Services, this Privacy Policy applies as stated above.

III. Sharing of Information

Our Website includes videos hosted by Vimeo and integrated into our Website via a plug-in. Vimeo is operated by Vimeo, LLC located at 555 West 18th Street, New York, New York 10011 (“Vimeo”).

In order to make the integration as secure as possible, we integrate these plug-ins using what is known as the two-click method. This means no personal data is passed on to Vimeo simply by visiting our Website. Only by clicking on the video does Vimeo receive the information that you have accessed our Website. By activating the plug-in, your personal data may be transferred to Vimeo and possibly stored by that organization in the form of cookies. We have no influence on Vimeo’s data collection, data processing and data deletion processes. If you are logged in with Vimeo, Vimeo may assign this information to your personal user account. If you wish to prevent this potential assignment of data, log out of your Vimeo user account before using our Website and deleting the corresponding cookies from Vimeo. • Course completion information. We may share your information with an individual or institution that paid directly for course enrollment for you.

• Affiliate and Partners. We may share your information with affiliates and select partners for a variety of purposes, including research, business, operational, and promotional purposes.

• Third-Party Ad Serving and Audience and Traffic Measurement Services. We may use third parties to serve advertisements on the Services. Third parties may set their own cookies or similar web technologies to collect information about users’ online activities over time and across different websites.

• Service Providers. We may share your information with service providers that perform certain functions or services on our behalf (such as to host the Services, manage databases, perform analyses, or send communications for us).

• Other Parties When Required by Law or as Necessary to Protect the Services. VI. Children’s Privacy; Persons Under the Age of 16

The Services are directed to a general audience. Our Website and/or Services is not intended for anyone under the age of 16. Please note that any use of the Website or Services by anyone under the age of 16 is prohibited, as described further in our Terms and Conditions. We do not knowingly collect, use, or disclose personal information from children under the age of 16 without prior parental consent, except as permitted by the Children’s Online Privacy Protection Act (“COPPA”). If we learn that we have collected personal information from a user under the age of sixteen, we will promptly delete personal information collected from that user.

VII. Your California Privacy Rights

The California Consumer Privacy Act (CCPA) gives certain consumers that reside in California the right to know what categories of personal information ACUE collects about them and how and for what purposes we use and share that information.

As set forth in this policy, we collect certain personal information from you and from other categories of sources. Section I above identifies the categories of personal information we collect (including identifiers, customer records information, characteristics of protected classifications under California or federal law, and internet or other electronic network activity information). We may use this personal information as set forth in Section II for the business and commercial purposes identified in Section II. We may share and disclose this personal information with third parties as set forth in Sections III and IV.

ACUE does not sell personal information to third parties within the scope of the application of the CCPA.

You have the right to request that we disclose to you (i) the categories of personal information we collected about you and the categories of sources from which we collected such information; (ii) the specific personal information we collected about you; (iii) the purpose for collecting personal information about you; and (iv) the categories of personal information about you that we shared or disclosed and the categories of third parties with whom we shared or to whom we disclosed such information in the preceding 12 months. You also have the right to request that we delete personal information we collected from you subject to certain exceptions.

You also have the right to not be discriminated against in pricing and services because you exercise any of your rights under the CCPA. ACUE does not offer financial incentives to consumers in exchange for the retention or sale of a consumer’s personal information.

Some web browsers may transmit “do-not-track” signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. Because there currently is no industry standard concerning what, if anything, websites should do when they receive such signals, we may take no action in response to these signals. If and when a final standard is established and accepted, we will reassess how to respond to these signals. In some cases, third parties may be able to collect information about a user’s online activities over time and across different websites when he or she uses our Services.

For California residents, California Civil Code Section 1798.83 gives you the right to ask us for information regarding the disclosure of your personal information to third parties for the third parties’ direct marketing or advertising purposes. If you reside in California and are under the age of 18, California Business and Professions Code Section 22581 gives you the right to ask and obtain removal of content or information you have publicly posted. Even if such a request is made, ACUE is unable to guarantee that that every item of content or information can be fully removed, despite our reasonable efforts. It is also possible that the applicable law may not require removal. We will deliver personal information that we are required by law to disclose to you in the manner required by law within 45 days after receipt of a verifiable request, unless we notify you that we require additional time to respond, in which case we will respond within such additional period of time required by law.
